Tuesday, February 9th 2010
Good afternoon everyone!  Just an update on the case of Christian Educators Association International's Motion To Intervene in the Santa Rosa County School case.  Judge Rodgers has not issued a ruling yet.  The hearing and testimony was heard in early December.  I talked with Harry Mihet, attorney for Liberty Counsel that argued the case, still no word from the court.
I have attached some information about the 34th annual governmental prayer breakfast on Saturday, February 20 at Pensacola's New World Landing.  Matt Shaver, Founder of Liberty Counsel, will be speaking.  Frank Lay will be awarded the Lifetime Achievement Award.  All details and information is included in the attached.  If any of you would like to attend the phone number and price of the breakfast is included.
Thanks, again.  As soon as any word comes down from the court, I will post it on the website and send out an email.
Robert

Trial Update

The closing argument for the CEAI Trial was filed by  Liberty Counsel on Friday, Dec. 18.  ACLU has 21 days to file their closing arguments with the court.  A decision should be made in mid to late January.  This is in regards to Christian Educators Association International request to intervene and attempt to change the Consent Decree to protect the rights of it's members that are employed by the Santa Rosa County School District. The written closing argument in available on our download page.

TRIAL UPDATE 12/3/2009:
As you know, Liberty Counsel has petitioned the court to intervene on behalf of the Christian Educators in regards to the Consent Decree signed by the Santa Rosa School Board.
The trial went until 6 PM last night and begins again this morning at 9:30.  It could possible go into tomorrow as well. Robert will be in the courtroom.
Liberty Counsel is the only one that is presenting witnesses.  They had 2 yesterday and they were on the stand for quite some time.  The ACLU is cross examining Liberty Counsel's witnesses, of course.
Please be much in prayer as this could make a huge difference in the restrictions that this consent decree puts on the School Board Employees.
Please say a special prayer for Harry Mihet, counsel for the Liberty Counsel and he was not feeling well yesterday.  Please pray for his quick healing.  He has been a most valuable asset for us.  Please hold him up in prayer today.
BREAKING NEWS - Important Prayer Request:

Please be in prayer this week for a VERY IMPORTANT court case.  On Wednesday, December 2, at 1:00 PM, Liberty Counsel will be representing the Christian Educators Association International (CEAI) in U. S. District Court, Pensacola.  Christian employees of the Santa Rosa County School District contend the Constitutional rights are being violated by the Consent Decree agreed to between the school district and the ACLU. Both the school district and the ACLU are strongly opposed to this request by Liberty Counsel.
If the court allows for the Motion to Intervene, Liberty Counsel will be allowed to represent the interest of these Christian employees before the court.  This is so important as it may allow many of the constraints placed on the employees to be lifted.
As you know, Liberty Counsel has successfully represented Michelle Winkler, Frank Lay and Robert Freeman in earlier cases before this court.
The hearing is open to the public at the U. S. Federal Courthouse at Palafox and Garden Streets in downtown Pensacola.

Presentation of $64,684.68 Check from Lay Freeman Defense Fund to Liberty Counsel

The Lay-Freeman Defense Fund was established by Dr. Noel Spurlock, Carol Cranford Jones and Robert Smith - all long-time friends of Frank Lay.
Pictured above, left to right are Dr. Noel Spurlock, Robert Freeman, Harry Mihet (Liberty Counsel), Robert Smith, and Frank Lay.

From Harry Mihet, Senior Litigation Counsel for Liberty Counsel:

"We are incredibly grateful to the people of Santa Rosa County for the privilege to fight for their constitutional liberties, and for partnering with us in this historic contest," said Mihet. "Their generous gift today will help us answer the $64,000 question that everyone in Santa Rosa County has been asking: "What happened to the Constitution and how long will it be in exile?

"We will not tire and we will not give up until it returns and once again reigns supreme."

Thank you for your support in this matter.  All of the legal expenses for Frank Lay, Robert Freeman and Michelle Winkler have been met.   We have presented a Check to Liberty Counsel for $64,684.68.   Liberty Counsel is still in the fight for Santa Rosa County.  They are hoping to intevene on behalf of the Christian Educators and possibly revisit the Consent Degree.  This is an expensive legal battle.  The fund is till open and all funds donated to the Lay Freeman Account will be going directly to Liberty Counsel to help in the fight.  Please be advised - The funds donated through this account are NOT tax deductible.  You may send them directly to Liberty Counsel in which case they will be tax deductible.  The address can be found on the Legal Expense Fund Page.  Thank You Again!
