The written closing argument for the
CEAI Trial was filed by Liberty Counsel on Friday, Dec. 18. ACLU has 21 days to file their closing arguments with
the court. A decision should be made in mid to late January. This is in regards to Christian Educators Association
International request to intervene and attempt to change the Consent Decree to protect the rights of it's members that
are employed by the Santa Rosa County School District. The written closing argument in available on our download page.

The trial went until 6 PM last night and begins again this morning at 9:30.
It could possible go into tomorrow as well. Robert will be in the courtroom.
Liberty Counsel is the only one
that is presenting witnesses. They had 2 yesterday and they were on the stand for quite some time. The ACLU is
cross examining Liberty Counsel's witnesses, of course.
Please be much in prayer as this could make a huge difference in the restrictions
that this consent decree puts on the School Board Employees.
Please say a special prayer for Harry Mihet, counsel for the Liberty Counsel
and he was not feeling well yesterday. Please pray for his quick healing. He has been a most valuable asset for
us. Please hold him up in prayer today.

Please
be in prayer this week for a VERY IMPORTANT court case. On Wednesday, December 2, at 1:00 PM,
Liberty Counsel will be representing the Christian Educators Association International (CEAI) in U. S. District Court, Pensacola.
Christian employees of the Santa Rosa County School District contend the Constitutional rights are being violated by the Consent
Decree agreed to between the school district and the ACLU. Both the school district and the ACLU are strongly opposed
to this request by Liberty Counsel.
If the court allows for the Motion to Intervene, Liberty Counsel will be allowed to represent the interest
of these Christian employees before the court. This is so important as it may allow many of the constraints
placed on the employees to be lifted.
As you know, Liberty Counsel has successfully represented Michelle Winkler, Frank Lay and Robert
Freeman in earlier cases before this court.
The hearing is open to the public at the U. S. Federal Courthouse at Palafox and Garden Streets
in downtown Pensacola.

Mihet, attorney with Liberty Counsel. As you know, Liberty Counsel will be handling the case for the Motion To Intervene
before Judge Rodgers on December 2, 2009. When he comes up for the hearing Frank Lay and Robert Freeman will be presenting
him with a check for over $63,000 for Liberty Counsel. The exact amount will be posted on the website at that time.
The Motion to Intervene is a very important case.
Liberty Counsel is requesting the Consent Decree be reconsidered by the court. They believe certain Constitutional rights
of Christian employees of the Santa Rosa County School District have been violated by the Decree.
Until this case is complete, we will continue to accept contributions to the
Lay & Freeman Defense Fund to help Liberty Counsel fund the case. Contributions

We have no way of knowing just how many churches brought buses and vans of supporters to downtown Pensacola on trial day.
I do know that Bro. Mike Boles chartered a bus and brought folks from Meridian,
MS. What dedication!!!!!
I was told that Bro Matt Cotton of Pine Terrace Baptist Church
in Milton ran shuttles all day from the Civic Center to the courthouse, as well as from the First Baptist Church of Pensacola
to the courthouse. Thank you Matt! Bro. Eddie Eaton from West Pittman
Baptist Church in Westville, FL. Pastor Eaton has been present at Michelle's trail, the benefit fundraiser
at the Opry House and Frank and Robert's trail. Thank you Bro Eddie for your stedfast support.
Within the next week we will know how
much is owed to the criminal attorneys that represented Frank and Robert. We will pay them and the remainder will go
to Liberty Counsel for their untiring work in this case.
If we've overlooked ANYONE, please
let us know. There's been so many involved we could have easily overlooked someone unintentionally.
We will keep the website operating in
order to keep everyone informed about the upcoming hearing. Liberty Counsel has filed a Motion To Intervene in behalf
of the Christian Educators Association International (CEAI). Liberty is asking the court to be allowed to be a part

We have just received word that the trial has been moved to the 5th
floor to accomodate more people. If you are trying to get inside the courtroom, you need to arrive early - we are suggesting
about 6:30. The courthouse doors do not open until 8:30. You cannot wear any type of clothing that has any messages
on it. You cannot take any electronics, including cell phones into the courtroom. If you are staying outside, be sure
to bring lawn chairs, umbrellas, drinks and quarters for the meters. PLEASE plan to be respectful and peaceful.
We want God to be glorified inside and outside the courthouse. Remember - unsaved people will be watching this. They
do not understand what our concerns are. We want to draw them toward God - not scare them away. First and foremost -
lets show them God's love in the way we act tomorrow.

What a success last night!! The initial total
receipts from the benefit at Farmers' Opry is $16,750!!!! We have not yet had a chance to total up the receipt from
pre-sale tickets paid for by credit cards.
This brings the total receipts as of 5pm 9/11/09 to:
$60,408.40!!!!
Thanks to all that have help in this
effort. A special thank you to Sue Hendricks of Jay and Sandi Wyatt of the Farmers' Opry. They planned the
benefit event and what a job they did! The volunteers that helped serve, cook, park, and greet cannot all be mentioned,

Only TWO DAYS until the Farmers' Opry Benefit for Frank and Robert!

Serving of Hamburgers,
Baked Beans, Potato Chips, soft drinks and water will begin at 5:30 PM. We're asking
for a donation of $10.00 per person. Serving will take place inside the Opry building. People can eat inside as
room allows. Overflow can eat outside.
Be sure to bring lawn chairs as the stage will be
set up outside. There's plenty of parking as we'll have folks to help you park and get served. PLEASE, tell
as many people as possible as we really would like a big turnout. The media will be present so we want the world to
know "WE WANT AMERICA BACK"!!! Pace High will have a football game in Tallahassee,
so a lot of the football and band parents will not be at the Opry. So we need a lot of folks to help make up for these.
We hope to be completed
by 8:15 - 8:30. The program consists of patriotic music from the Saw Mill Band, Gospel Music from The Henderson's
and Crossroads. Speakers will be limited to a max of 5 minutes each. They include:

GOOD NEWS!! This morning U S Federal
Judge Casey Rogers heard arguments from Liberty Counsel in behalf of the Christian Educators Association International (CEAI).
They had filed a Motion To Intervene in the case of the ACLU vs Santa Rosa County School Board. Liberty Counsel is alleging
that the Consent Decree agreed to by the School Board and ACLU violated certain Constitutional rights of the teachers.
Today Judge Rogers agreed to extend the hearing and will issue an order next week establishing a date for additional briefings
and proceedings to hear more information from Liberty Counsel. The court feels the question
of possible violations of Constitutional rights of the teachers is worth the extended time
and effort. Liberty Counsel will be preparing more information for the Judge to consider. Hopefully, the
court will allow CEAI to intervene, which could result in changes to the Consent Decree.

We have been in discussions with the City of Pensacola in regards to assembling
in downtown Sept 17 for the trial. The police department and the city managers office
has told us we do not need any permits. They said we have the Constitutional right of
assembly. They will require that no traffic be impeded
and all streets remain clear. We can gather across the street from the federal courthouse
and on the sidewalks.
The U S Marshall's office informs us that no one will be allowed to stand on the courthouse steps or inside the courthouse. Please encourage anyone
and everyone you know to come to downtown Pensacola to show support for Frank and Robert!! It would be wonderful to
have several thousand to show up. If Michelle Winkler's trial is any indication, this could be an all day event.
People attending may want to think about bringing folding chairs, cold drinks and something to eat.
For those of you that may
not be aware, parking in downtown Pensacola is somewhat limited. You will need to bring some
quarters as the parking meters only use quarters.
For anyone attending the benefit on
Sept 10 at the Farmer's Opry, parking will be no problem There's
plenty of room. Again, you may wish to bring lawn chairs as the event will be held outside.
Anyone coming from out of town, or even locally, there will be RV sites
available at the Opry. You can call 850-994-6000 for reservations and costs.

The total contribution from the
Thursday night and Sunday fund raiser is in.
As you know, 10% of sales on Thursday from 5:00 - 8:00 PM and 10% of all day sales on Sunday
are being donated by CiCi's Pizza. On top of that, the owner, Mr. Brandon Ward has agreed to match the amount.
The total contribution for both days is $519.48.
Remember, CiCi's will donate 10% of all sales for the next 2 Sunday's. Also, VERY
IMPORTANT, be sure to put your receipt in the box provided. If you don't, we will not get credit.

Liberty Counsel's Motion
To Intervene will be heard by U S Federal Judge Casey Rogers this Friday, Sept 4 at 8:30 AM at the Federal Courthouse
in downtown Pensacola. As you may know, this is a request on behalf of the Christian Educators Association International
(CEAI). CEAI is asking permission to take part in the proceedings to have their interest protected. They allege
the rights of Christian educators have been infringed upon by the Consent Decree agreed to between the Santa Rosa County School
Board and the ACLU. The courtroom proceedings are open to the public. The courtroom gallery will accommodate approximately
60 people

Great
News!!! Judge Rogers ruled late this afternoon against
the ACLU motion to hold Michelle Winkler in Contempt of Court. Liberty Counsel argued that the prayer Michelle had her
husband pray at the annual Employee of the Year Banquet was not a school sponsored event. The Judge agreed that the
event was sponsored by the Santa Rosa Educational Foundation which is a non-profit organization that supports the Santa Rosa
County School Board. The ACLU had asked the court to find her guilty of disregarding the Consent Decree agreed to by
the ACLU and Santa Rosa School Board AND pay court costs and the legal fees of the ACLU for bringing the case. All was
denied!!

A Message from Congressman Jeff Miller
Dear Ms. Curvin,
Thank you for taking the time to write me about the situation regarding prayer at Pace High School.
This issue is very troubling and I am glad you wrote to share your views and concerns.
Below
is an editorial I submitted to the Pensacola News Journal on August 14 in response to an August 8, 2009 opinion article on
school prayer by Mr. J. Earle Bowden. This encompasses my viewpoints, and I will be offering my support to the Pace
community as the situation progresses. I support Pace High School and believe we should not prosecute people for offering
a simple prayer before a meal.
Text of my editorial: "After reading Mr. Bowden's August
8 editorial, one would think that Thomas Jefferson was the final and only authority on all church and state issues during
the founding years of our country. We are left to believe that the First Amendment came out of the "Jeffersonian
essence of religious freedom."
But what Mr. Bowden fails to mention is that there were NINETY framers of the
First Amendment, and Thomas Jefferson was not one of them. While Mr. Jefferson was serving as Minister to France, Congress
debated the wording of the Bill of Rights. According to the Congressional Record from 1789, not once during the months
of debate did the framers mention the words "separation of church and state."
The origination of this
phrase comes from a letter newly elected President Jefferson penned to a group of Baptists in Danbury, Connecticut in 1802
regarding religious freedom. There is probably no other occasion in history where a sentence from a personal note,
taken out of context, has become the foundation for U.S. policy.
When we put the Danbury letter in perspective,
we see that Jefferson was responding to the question of religious establishment. The Baptist congregation specifically
questioned the government's interference in the church, not the religious principles of our government leaders.
Jefferson accurately responded that the First Amendment precluded the government from establishing a religion or denomination.
Jefferson did not state that religion has no place in our government.
The "wall of separation between church
and state" is a one-way wall. It was not the founders' intent to keep God out of the government, but to keep
the government out of the church.
There are hundreds if not thousands
of documented expressions of the importance of religion and Christian principles by our Founding Fathers. From the Mayflower
Compact to the Declaration of Independence and beyond, early American leaders believed as George Washington believed that
"it is impossible to rightly govern the world without God and Bible."
It was not until the late 1940's
when a liberal Supreme Court began to misinterpret Jefferson's words. Earlier courts held that the government may
step in only when religious principles turn into dangerous actions such as polygamy or human sacrifice. But the government
has no right, and is in fact PROHIBITED from interfering with religious practices and beliefs, whether that be in the church
or in the classroom.
Although Mr. Bowden sidesteps the issue of Pace High School and prayer in our schools, I will
not. Precluding prayer at student events is wrong. Prohibiting a class president from speaking at graduation because
she might mention God is offensive. And prosecuting a man as a criminal for offering a prayer before a meal is abhorrent.
I am proud of the Pace community for standing up for our country's founding principles of a faith in God that
cannot be broken. Americans must be free to worship when they please, free to pray where they please, and free to speak
what they please. These are the very basics of our American liberties and the foundation upon which this country was
built.
For as Thomas Jefferson argued, "The constitutional freedom of religion is the most inalienable and
sacred of all human rights.""

Tonight during our show at the
Opry I announced the Sept 10th event and there are typically folks from all over there so I explained to the audience what
it was about. When we broke for intermission a 10 year old boy from Texas walked up to the stage and handed me a $10 dollar
bill. He said his family was going home tomorrow but he wanted to help. His Mom came up and said he insisted on it. Then,
a little later an 8 year old boy from Denmark came to me and gave me $30. $10 each from he, his Dad and Mom. Shortly, a small
girl about 10 yrs old came to me and said she only had $9 but wanted it to go to our cause. I was stunned. Then a lady from
Virginia with terminal cancer gave $100. And it continued. We were not pushing it and we didn't harp on it. I just
mentioned it one time from the stage and folks were stunned and upset.
On
Monday, the girls in my office will be prepared to sell advance tickets over the phone with credit cards or they can stop
by the office at 3616 Laurel Lee Blvd in Pace. (LaurelWood Subdivision on Chumuckla Hwy) $10 per ticket. On credit card orders
we're charging a $1 handling chg to cover the transaction fee and mail out. Thanks for all you, Linda and the station
are doing and let me know if I can help you.
